Seller Agreement

1. Becoming a Seller
To sell on 3DPrintMe, you must create an account and onboard a Stripe Connect Express account through Stripe-hosted Account Links. Identity verification, beneficial-ownership checks, tax-form collection, and bank-account verification are performed by Stripe under the Stripe Connected Account Agreement and Stripe Services Agreement, which you accept as part of Stripe onboarding. 3DPrintMe does not collect or store your full Social Security number, government identification, or bank account credentials. By completing onboarding, you agree to this Seller Agreement, the 3DPrintMe Terms of Use, the Stripe agreements identified above, and all policies incorporated by reference. This Seller Agreement supplements the Terms of Use. If there is a conflict between this Seller Agreement and the Terms of Use, this Seller Agreement controls for seller-specific matters.
Seller approval is at 3DPrintMe's discretion. There is no entitlement to seller status, and 3DPrintMe may decline or revoke seller access where onboarding, identity, risk, or policy requirements are not met. Your seller account and store profile are personal to you and may not be transferred or assigned without 3DPrintMe's prior written consent.
You may register as an individual or business seller. You are responsible for keeping all profile, payout, and tax identity information accurate and consistent across 3DPrintMe and Stripe.
2. Independent Contractor Status
You are an independent contractor and not an employee, agent, partner, joint venturer, or franchisee of Graff Technologies LLC. You have no authority to bind Graff Technologies LLC to any contract or obligation. Graff Technologies LLC does not control the manner or means by which you produce, source, or fulfill orders, set your hours, choose your equipment or materials, or operate your business. Nothing in this Agreement creates an employment relationship, and you are solely responsible for your own business decisions, methods, hiring, equipment, supplies, taxes, insurance, licenses, and operations.
3. Listing Requirements
- All listings must accurately describe the print including material, color options, dimensions, surface finish, tolerances, and estimated lead time.
- Photos must represent the actual print you will produce, and not renders or stock images unless clearly labeled as such.
- You may only list items you are capable of producing with your own equipment or with authorized subcontractors.
- Listings must comply with all applicable laws, our Content Policy, our Prohibited Items Policy, and our Community Guidelines.
- You are solely responsible for the accuracy of all listing information. Misrepresentation may result in account suspension and liability for buyer refunds.
- You are responsible for product safety, warnings, labeling, and substantiation of suitability claims.
- You must not claim medical, food-safe, child-safe, load-bearing, automotive, firearm-component, electrical, or other regulated-use suitability unless you can substantiate those claims with material specifications, testing results, or applicable certifications and confirm legal compliance for the intended use.
- You may not list, sell, or facilitate the sale of any firearm or firearm component, including frames, receivers, lower receivers, conversion devices, auto-sears, suppressors, magazines exceeding state legal capacity, or any item designed to defeat firearm serial-number or safety requirements. This restriction applies to physical prints and to digital files (including STL, STEP, 3MF, OBJ, and ZIP) of any such item, and it applies whether the file is offered for free or for sale.
- If your listing or any uploaded model file was created with material assistance from generative AI tools, you must flag the listing as AI-assisted using the platform's AI-assistance disclosure flag. AI assistance does not cure third-party intellectual property infringement. Your representations and warranties in Section 8 apply to AI-assisted content on the same terms as any other content.
3A. Digital Content Terms
For digital model listings, the sale contract is between the seller and the buyer. 3DPrintMe provides store infrastructure, payment facilitation, and file delivery tooling, and is not the merchant of record, licensor, or warrantor of your digital content. Stripe is the payments processor and may appear on the buyer's bank statement as the descriptor of record.
- You may only upload content you created or are licensed to distribute.
- You must clearly state applicable license terms and any usage restrictions on the listing.
- You must set prices to include any taxes or charges required by law for your jurisdiction and business type.
- You must keep sold digital files available for buyer access for a commercially reasonable period, unless legal or policy enforcement requires removal.
- If you rely on buyer-provided external links or files for a commission, you should request proof of rights before producing the item, and you must decline the commission where licensing is unclear or appears to infringe a third party. Producing a copy of a third-party design at a buyer's request does not shift infringement liability to the buyer.
4. Order Fulfillment
- You must fulfill orders within the lead time specified in your listing.
- All orders must be shipped with a trackable carrier (USPS, UPS, FedEx, or DHL).
- Failure to ship within seven (7) days after the stated lead time may result in automatic order cancellation and full refund to the buyer, with the refund amount, payment processing fees, and any chargeback or dispute fee deducted from your available balance or future payouts as authorized under Section 7. Repeated late-ship events may move your account to a higher-risk payout tier as described in Section 6A.
- You are responsible for ensuring items are packaged appropriately to prevent damage in transit.
- For commission orders, you must follow accepted quote scope and provide proof photos where required by the quote/workflow before final fulfillment.
- Where Shippo gray-label shipping is used, you are responsible for your Shippo account billing obligations, including carrier adjustments and label refund eligibility under Shippo/carrier rules.
5. Fees
3DPrintMe charges a platform fee on each completed transaction. The current standard fee is 10% of transaction value (item subtotal and shipping, excluding tax), unless a written promotional or enterprise agreement states otherwise. The current fee schedule is published in your Seller Dashboard and may be updated with thirty (30) days' advance notice by email or in-product notification. Your continued listing or sale of items after the effective date of a fee change constitutes acceptance of the new fee. If you object, you may close your seller account before the effective date and remain entitled to payout of cleared funds under Section 6. There are no monthly fees or listing fees unless explicitly stated in a separate plan.
Unless 3DPrintMe states otherwise in the Seller Dashboard or a written fee schedule, 3DPrintMe bears routine Stripe per-transaction payment processing fees out of its platform fee. Sellers are not charged a separate routine payment-processing-fee line item for completed transactions.
By onboarding to Stripe Connect Express, you accept the Stripe Connected Account Agreement and the Stripe Services Agreement directly with Stripe. You authorize 3DPrintMe and Stripe to debit, withhold, offset, or recoup from your available balance, pending payouts, future payouts, or reserves any chargeback fees, refunds, reversals, payment disputes, reserve amounts, and any other amounts recoverable under Section 7.
6. Payouts
Funds become payout-eligible after order completion and after any applicable payout hold under your seller risk tier expires. The default hold is three (3) days after the order is marked delivered. Sellers in the NEW tier (described in Section 6A) are subject to a fourteen (14) day probation hold. Hold windows vary by tier and risk status and may change over time based on account history, disputes and refunds, fulfillment performance, and policy compliance. Stripe's standard payout schedule applies after funds become available (typically 2 to 5 business days to your bank account). Graff Technologies LLC deducts its platform fee before transfer availability. Graff Technologies LLC is not responsible for delays attributable to Stripe's systems or your bank.
Graff Technologies LLC may change payment providers in the future. References to Stripe in this Agreement apply to any successor provider where context requires, and you agree to complete any onboarding required by the successor provider as a condition of continued seller access.
6A. Seller Payout Risk Tiers
To manage platform fraud and chargeback exposure, sellers are assigned a payout tier of NEW, TRUSTED, ESTABLISHED, or HIGH_RISK based on account age, completed-sales history, dispute and refund rate, delivery performance, fraud signals, and policy status. 3DPrintMe may apply rolling holds, reserves, manual review, or payout freezes based on these factors. The broad factors and the active hold reasons for your account are surfaced in the seller-facing dashboard. The specific anti-fraud scoring formulas and weighted thresholds are not published, both to prevent gaming and because publication would compromise platform security.
7. Refunds & Disputes
7.1 Buyer dispute categories. Buyers may open a dispute under one of the following categories: NOT_AS_DESCRIBED, ARRIVED_DAMAGED, ARRIVED_LATE, NEVER_ARRIVED, or OTHER. The applicable issue window depends on the listing category and is described in the Payment & Refund Policy and the Commission Policy, including the fourteen (14) day post-delivery issue window for physical prints, the non-cancellation rule for custom commissions after production begins, and the limited refund triggers for digital downloads after download.
7.2 Seller response window. When a buyer opens a dispute, you will be notified through the Seller Dashboard and by email and you will have forty-eight (48) hours to submit a response and supporting evidence (tracking events, delivery photographs, buyer messages, listing details, quote files, and related order data). If you do not respond within forty-eight (48) hours, 3DPrintMe may auto-resolve the dispute in the buyer's favor based on the available record.
7.3 Refund and recoupment authorization. You authorize 3DPrintMe and Stripe to debit, withhold, or offset against your available balance, pending payouts, and future payouts any amount necessary to fund (a) a refund issued under this Section 7, (b) a chargeback or payment reversal, (c) Stripe's chargeback fee (currently $15 per dispute) and any other processor fees passed through, (d) any reserve or rolling hold established under Section 6 or 6A, and (e) any indemnification obligation under Section 9 that has been reduced to a liquidated amount. If your available balance is insufficient, the shortfall is a debt you owe to Graff Technologies LLC, payable on demand.
7.4 Final resolution. Final dispute resolution within the platform rests with Graff Technologies LLC under the applicable policy windows. This Section 7 governs platform-level dispute handling only and does not waive any right you or the buyer may have to pursue a separate remedy under the dispute-resolution provisions of the Terms of Use.
8. Intellectual Property: Representations and Warranties
You represent and warrant that: (a) you own or hold valid, current licenses to all designs, STL files, 3D models, images, descriptions, and other content used in your listings and prints, including the right to reproduce, distribute, and prepare derivative works for the sale or download as listed; (b) your listings, prints, and derivative works do not and will not infringe any copyright, trademark, patent, trade dress, right of publicity, or other right of any third party; (c) printing or selling copyrighted characters, logos, brand identifiers, or patented designs without explicit written authorization from the rights holder is prohibited, and is prohibited whether the work was created by you, by a third party you commissioned, or with material assistance from a generative AI tool; (d) AI assistance does not cure any third-party intellectual property infringement, and your representations and warranties in this Section 8 apply on the same terms to AI-assisted content; and (e) you will promptly remove any listing on receiving a valid notice under the DMCA Policy or on request by 3DPrintMe acting in good faith to enforce this Agreement.
Violation of this section may result in listing takedown, account suspension or termination, permanent ban under the repeat-infringer policy described in Section 12, and your continuing liability for all damages and costs (including reasonable attorneys' fees) arising from the infringement.
9. Indemnification
You agree to defend, indemnify, and hold harmless Graff Technologies LLC and its officers, directors, employees, agents, successors, and assigns from and against any and all third-party claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) any print, digital file, or commission you manufacture, list, sell, deliver, or ship through the Platform, including claims of print defect, personal injury, property damage, or failure to warn; (b) any claim that your listings, prints, digital files, or derivative works infringe any third-party intellectual property right or right of publicity; (c) your breach of any representation, warranty, or obligation in this Agreement or the Terms of Use; (d) your violation of any applicable law or regulation; (e) any tax obligation allocated to you under Section 10; or (f) any dispute between you and a buyer regarding an order, including any chargeback or reversal. Graff Technologies LLC will give you prompt written notice of any claim, will allow you to control the defense with counsel reasonably acceptable to Graff Technologies LLC, and will reasonably cooperate at your expense. You may not settle any claim that requires Graff Technologies LLC to admit liability, pay money, or take or refrain from taking any action, without Graff Technologies LLC's prior written consent. Graff Technologies LLC may participate in the defense at its own cost with counsel of its choice. This indemnification obligation survives termination of your seller account.
10. Tax Obligations
As an independent contractor, you are solely responsible for all federal, state, and local taxes on your earnings from the Platform, including income tax, self-employment tax, and any applicable business or excise taxes. Graff Technologies LLC currently acts as a marketplace facilitator and collects and remits sales tax (through Stripe Tax) on your behalf for transactions in states whose marketplace facilitator laws apply to the Platform. You are not responsible for collecting or remitting sales tax in those states for transactions processed through the Platform. The list of marketplace facilitator states is maintained in the Seller Dashboard and may change as state laws or Platform operations change. For transactions in non-marketplace-facilitator states, you remain responsible for any sales tax obligations, and should consult your tax advisor. Sellers whose gross sales exceed IRS reporting thresholds will receive an IRS Form 1099-K from Stripe. You must provide accurate taxpayer identification information (SSN or EIN) when requested. Failure to provide accurate tax information may result in backup withholding or account suspension.
11. Shop Conduct
- Maintain professional, respectful communication with buyers at all times.
- Do not attempt to conduct transactions outside of 3DPrintMe to circumvent fees.
- Do not manipulate, incentivize, or solicit reviews or ratings.
- Do not use the Platform's messaging system for spam or unsolicited commercial communications.
- Do not misrepresent your qualifications, equipment, materials, or production capabilities.
12. Account Suspension & Termination
3DPrintMe may suspend or permanently terminate a seller account for policy violations, high dispute or refund rates, fraudulent activity, intellectual property infringement, breach of any representation or warranty in this Agreement, prohibited-item activity, or other conduct that 3DPrintMe reasonably determines is harmful to the Platform, its users, or third parties. Where reasonably practicable and consistent with platform safety, 3DPrintMe will provide notice and an opportunity to cure non-fraudulent, non-IP, non-prohibited-item violations.
3DPrintMe maintains a repeat-infringer policy under which sellers who receive multiple substantiated IP complaints (typically three valid notices within a rolling twelve-month period, or fewer where the infringement is willful or involves clearly recognizable third-party IP) will be terminated, and may be banned from re-onboarding to the Platform.
On suspension or termination, outstanding funds may be held while open chargeback, dispute, refund, or investigation matters remain open, and for a reasonable additional period (not to exceed one hundred eighty (180) days from the latest triggering event) to allow Stripe's chargeback windows and the Platform's reserve mechanics under Section 6A to run. Funds not subject to a hold, reserve, recoupment, or pending dispute will be released to your Stripe account on the next scheduled payout cycle. Termination does not relieve you of obligations incurred before termination, including indemnification, recoupment, and survival obligations.
12A. Seller Complaints and Escalations
For seller complaints regarding account actions, payouts, or policy enforcement, contact sellers@3dprintme.com and include your shop name, account email, relevant order or listing IDs, and requested resolution. We aim to acknowledge complaints within 5 business days and provide a substantive response within 15 business days.
12B. Dispute Resolution
Any dispute between you and Graff Technologies LLC arising out of or relating to this Agreement, your seller account, payouts, or your use of the Platform is governed by the dispute-resolution provisions of the 3DPrintMe Terms of Use, including the requirement to attempt informal resolution through sellers@3dprintme.com under Section 12A, the binding individual arbitration provision (JAMS, Streamlined Arbitration Rules), the class-action waiver, the thirty (30) day opt-out window measured from your acceptance of this Agreement, the choice of King County, Washington as the venue for any non-arbitrable matter, and Washington law as the governing law. Nothing in this Section 12B limits Graff Technologies LLC's right to seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or platform integrity, including to enforce Sections 3, 7, 8, or 12.
13. Survival
Sections 2 (Independent Contractor), 7.3 (Refund and Recoupment Authorization), 8 (IP Representations and Warranties), 9 (Indemnification), 10 (Tax Obligations), 12 (Suspension and Termination), 12B (Dispute Resolution), and any accrued payment obligation survive termination of this Agreement.
